AGREEMENT
Search schedule:
Rust & Associates, Inc. (Rust) agrees to conduct a
search for position title for your company. Rust
will use their best efforts to present four to six qualified candidates on
or before four to six weeks. The presentations will
include a profile, references, interview results and relative
strength of each candidate. Rust will recommend a compensation
package and will assist with the job offer, salary negotiations and
relocation package if requested. The search will continue until this
position is filled.
Guarantees:
If this search has not been successfully concluded by date,
your company may request a refund from Rust of all fees paid to
Rust under this agreement, exclusive of out of pocket research expenses
and other expenses pre-approved by your company. Rust
also unconditionally guarantees the candidate, hired under this agreement,
will remain an employee of your company for two years after
the date of hire. If the candidate is terminated, voluntarily or
involuntarily, your company, at your option, may request
Rust to refill the position for no additional search fee. Out of pocket
research expenses and pre-approved expenses only, may be billed under
this option.
Fee schedule:
An initial retainer of $1/3 of fee will be
invoiced at the start of the search. A second $1/3 of fee will
be invoiced after thirty days, and a third $1/3 of fee will
be invoiced after sixty days. A final invoice will be billed at the
conclusion of the search for the difference between the fees already paid
and one third of the candidate's expected first year cash compensation.
Expenses:
Rust will pay all research, telephone, electronic
transmission, administrative, Atlanta area travel and entertainment
expenses and will only request your company's
pre-approval for other appropriate expenses.
Other:
If a refund is requested, paid and subsequently a
candidate presented by Rust is hired by your company
, the refunded portion of the fee is again due and payable by your
company. If additional candidates presented by Rust are
hired by your company, an additional fee equal to
one third of each candidate's expected first year cash compensation is due
and payable by your company.
